Godswill Akpabio Loses to Ekpenyong as Tribunal Dismisses Petition
The national and state house of assembly election petitions tribunal, sitting in Uyo, Akwa Ibom State, has upheld the election of Christopher Ekpenyong, striking out Senator Godswill Akpabio’s petition.
Delivering judgment, the Chairman of the three-member panel, Justice W.O. Akanbi, held that Ekpenyong, a member of the Peoples Democratic Party was duly elected by majority votes cast during the senatorial election.
Akpabio, the first petitioner had challenged the elections on the ground that Ekpenyong was not duly elected by the majority of lawful votes cast and that the process that elected him contravened the Electoral Act.
Describing the petition as “lacking merit”, the panel noted that the petitioner failed to prove that he won the said election as well as failed to present convincing evidence of noncompliance with Electoral Act as raised in his petition.
